PCM and the Berthstherein are for Members of PCM and Reciprocals only.

All boats berthedwithin PCM, must be equipped with suitable and adequate fire extinguishers.

No Barbecue may beused either on a boat or pontoon within the Yacht Haven.

No vessel shallsail within PCM except approved vessels.

No vessel shallanchor within PCM.

Vessels enteringor leaving PCM shall be navigated in such a manner as to not endanger orinconvenience other vessels.

Vessels enteringor leaving PCM shall:

a)    Keep asharp lookout for other vessels moving in PCM or approach channel, making anappropriate sound signal if necessary.

b)  Maintain a low speed and obey anytraffic control signals.

c)    Maintain listening watch on Channel M (37)where possible.

Swimming, divingand SCUBA diving and fishing are forbidden in PCM without the written consentof the Club Secretary or a member of PCM & Yard Committee.

No radios, musicalinstruments or the like shall be played on any boat within PCM so as to beaudible outside of that particular boat.

No major refittingor repair shall be carried out to any boat berthed in the PCM.

Rubbish must onlybe placed in the receptacles provided by the Club.  Used batteries and oil filters must bedeposited in the appropriate bins provided on site.

All boats must besecured in a seaman-like manner with adequate fendering to protect adjoiningboats.  Further, no equipment otherthan berthing lines and electric cables (when in use) shall be placed on thepontoons.  No part of the boat or itsequipment shall be permitted to overhang beyond the pontoons white line.

Dinghies may notbe left alongside any boat in PCM when not in use or obstruct navigation toany other part of the marina including, in particular, an adjoining berth.

Members andVisitors shall comply with all reasonable instructions of the Secretary inconnection with all matters relating to the safe and efficient operation ofthe marina.

A berth occupiedby a visitor must be vacated by noon on the day of departure.

It shall be held arequirement that the owner of any vessel or craft shall maintain insurancewith reputable insurer in respect of:
a)    Hull coverage in an amount of not lessthan the full market value
b)   General third party cover to a limit anyone occurrence:  MINIMUM OF£2,000,000.
All suchinsurances shall be so written to provide that the Insurers shall have norights of recovery against PCM, Chalcolithic Enterprises Limited,the Committee and employees of the Club. It is a requirement of the Club that a copy of the current insurancecertificate is lodged with the main office for reference.

All children underthe age of 12 must be accompanied by an adult (a responsible person over 18years of age).  When in the vicinity ofPCM, the Slipways or on the Pontoons, children must wear automatic orinflated lifejackets.

No Vessels orvehicles may be used on the club premises for commercial gain, charteror any illegal purposes.

Only licensedberth-holders are allowed to use their allocated berths in the marina.  The Victualling and Visitors’ pontoons areavailable to Members, but particular Byelaws apply.

Other Memberswanting to use vacant berths, even for a short period, must obtainauthorisation from the Secretary or a member of the Yard Staff before usingthe berth.

Maximum dimensions of vesselsallowed to use the marina:-

LOA 24m, thisincludes all projections (anchors, pulpits, pushpits and davits).  The maximum draft is 3.5m.  Any craft over these limits, with theexception of berths (to be allocated) whichcan accept 30m overall, may not enter or useberths in the marina.  Measurementswill be taken of all craft periodically. (Current Licence Holders with boats temporarily outside these dimensionsmust advise their insurance companies). It is essential for insurance, manoeuvrability and the safety of boatsin the marina that this rule is adhered to strictly.

Visitors’Casual Berthing on East Pontoon:
Berths E2 and E3are available solely for PCM Members and approved reciprocal clubs, withboats up to 38’ maximum including all projections.  Between 09.00 and 18.00 berthing is limitedto two hours (free) after which the berth must be vacated.  Overnight berthing only allowed from 18.00to 09.00 at a charge based on LOA.

No reservationsmay be made before 30 minutes of arrival and a member of the Yard Staff mustbe advised of all arrivals.

b)

For possiblelonger vacancies in other berths (at a charge per week/m LOA) contact amember of the Yard Staff.

c)

No double berthingis allowed at any time, without the direct permission of a member of the YardStaff, the marina/Yard Sub-Committee Chairman or a Flag Officer.  Anyone contravening this rule may be fined£50.

TheVictualling/Emergency Berth is only available for short stays of less than 15minutes, unless authorised by the marina/Yard Sub-Committee Chairman, a FlagOfficer or the Secretary.  A Member ofthe crew must remain aboard at all times. It is essential that the berth is kept clear for this purpose.  Anyone contravening this rule may be fined£50.

Vessels shall beberthed or moored by the Member in such a manner and position as the Club mayrequire and necessary warps and fenders shall be provided and maintained bythe Member.  Members must ensure thatwarps securing boats are sufficient strength to do the job properly.  Members should ensure that fenders aresufficient in number and are large enough to prevent damage in roughconditions.

No vessel shall bemade fast to any other vessel within the marina, without the directpermission of the Secretary, the marina/Yard Sub-Committee Chairman, or aFlag Officer.

BERTH LICENCE

In the interestsof safety, Berth Licences may only be held by Members with a provencompetence to handle their boat in the close confines of PCM to thesatisfaction of the Chairman of the marina/Yard Sub-Committee or an Officerof the Club nominated by him.  Thisconsideration applies to all persons to whom the Member may at times delegateresponsibility for taking charge of the handling of the vessel in PCM.

Each berth has apre-defined size.  All boats will notexceed that designated size for any reason. All berth-holders may have their boats measured on land to verifytheir stated dimensions.

No changes inberth positions are allowed except by order of the Secretary.

No moving up ordown in berth size except via the waiting list.

No berth shouldhave a boat LESS than 5ft of its designated size in it, at any time.

If, when offered,a berth is not satisfactory in any way then the advice should be not to takeup the offer, but to wait for the next available berth.

No Member may haveor share two boats in the marina, thus a Member may only have one licence forone berth in the marina.  TheseLicences are granted annually.

Nothing in theLicence shall entitle a Licence Holder to the exclusive use of a particularberth.   All vessels in the marina maybe moved by the Club to any other part of the marina from time to time asthey see fit.

The Licence Holdershall not transfer or assign the berth allocated to him/her.  If a Member wishes to relinquish a berth,two months’ notice is to be given.  Norefund of berthing fees is to be paid until a berth has been re-let.  The incoming berth holder will be invoicedfor fees from the date of PCM confirming (the Member’s) verbal acceptance ofthe vacant berth.

The club reservesthe right to cancel the berth licence of any Member who is deemed by theCommittee to be in breach of these conditions.

SHARED BOATS IN BERTHS

The Annual Licencewill be in the name of one voting Member who is the owner or majority ownerof the vessel, not a family or minority owner.  Where equal shares are held, one of theowners only is to be nominated as the Licence Holder.  Members who are part owners and are not thenominated Licence Holder may elect to lodge a separate deposit and join theWaiting List.  It should be understoodthat when the nominated Licence Holder ceases to require the berth, it wouldbe offered to the Member at the top of the Waiting List.  A Berth Licence will not be passed to thepart owner, spouse or family Members unless they are at the top of theappropriate category of the Waiting List.

If, beforedeparture, the Licence Holder notifies the Club of his intended absence formore than 60 hours he will then be entitled to 50% of any casual licence feescollected by the Club in his absence. Casual berth fees will be collected on all occasions except wherewaived at the discretion of the marina and Yard Committee.

Berthing fees willbe collected 12 months in advance. Prolonged absence from the berth does not entitle the Member to arebate.  However, PCM Bye-Law 37 willapply.

Absence of theMember’s boat from his berth for more than 364 days, will lead to forfeitureof the berth.

The Member shallleave the keys of his vessel in the care of the Club office.  (This is for staff use in emergency, e.g.fire, seawater ingress).

Berth LicenceHolders may use the slipway at no charge to launch and recover their owntenders.  Power is available fromlockable, metered sockets.  Tripswitches limit the supply to about 5 amps per boat.

Except in the caseof vessels using a re-circulating or holding tank system, lavatories aboardvessels must not be used whilst the vessel is in the Haven.  Lavatory facilities are provided ashore.

Dates for slippingor re-launching cannot be guaranteed.

Berth Holders maynot make any permanent attachments to the pontoons without priorauthorisation from the Club Secretary. Unauthorised fixings will be removed and any damage to the pontoonmade good at the berth holder’s expense.

MARINA WAITING LIST APPLICATION

The procedure andconditions for a Member to obtain a place on the Waiting List for a berth inthe marina are as follows:

a)    Onreceipt of a deposit for the appropriate berth size, the Member’s name willbe added to the Waiting List for the nominal size of berth requested, and thedate noted.

b)   Depositsare the equivalent of one year’s Annual Berth Licence fee for the berth sizeselected.

c)    The rateof interest will be fixed by the General Committee from time to time as ratesfluctuate.

A Member may onlybe registered on one Waiting List.

Members on theWaiting List who later choose to cancel their application before a berth isallocated must give 30 days notice of their request for the return of theirdeposit.

The Annual Berth Licence,when allocated, will be in the name of one voting Member only, not a familyor both part owners.

When a Memberacquires a berth, he comes off the Waiting List.

If he wishes to goon a Waiting List, a new current deposit is paid and the new date of entrynoted.

Temporary BerthHolders would be allowed into vacant berths in the marina but within therules above.

INSURANCE

REQUIREMENTAND DISCLAIMER

If the Club isnegligent or in breach of contract, either itself or through its employees,then it accepts that it will be liable to Members for any damages or lostproperty and legally recoverable as a result and it does not feel that it isright to try and limit that liability. That acknowledgement does not extend to the acts or omissions of individualMembers acting as individuals rather than on behalf of the Club.

The Club does notaccept liability for negligence or breach of contract by any other partywhether they be a Member, licensee, visitor, guest of another Member orotherwise.  The mere fact that a Memberor his property is damaged or, in the case of property, lost or stolen whilston the Club premises (and in the absence of negligence or breach of contractby or on behalf of the Club) does not mean that any liability falls on theClub.

The Club’s policyis to maintain reasonable insurance arrangements to enable it to meet anyliabilities, which properly fall upon it for negligence or breach ofcontract.  There is, however, a limitto the availability of such insurance. There may be economic or other restrictions making it unattractive orimpossible to maintain all the cover which the Club would like.  The Club’s insurance will only cover itsliability and so every Member should ensure that they maintain their owninsurances and be prepared to claim on those.

It must beremembered that the Club’s premises are, quite properly, frequented by peoplewho are outside the control of the Club. The Club is not liable for the acts or omissions of such people.

The Club has madevarious security arrangements to protect its premises and property and theproperty and other belongings of Members. The Club cannot guarantee the effectiveness of these arrangements orthat they will always be in place. Members must therefore take their own precautions.

Members are askedto bear in mind that we are all Members of the Club.  The Club is a Members’ Club and not acommercial organisation.  Many Membersgive their time and effort to the Club, exercising considerable dedication indoing so.  Please do not forget this ifever you should feel aggrieved.

It shall be held arequirement that the owner of any vessel or craft shall maintain insurancewith reputable insurer in respect of:

USE OF PREMISES

The working areascontain industrial hazards, e.g. moving vehicles, machinery, etc. and caremust be taken by everyone at all times.

No sanding offboats or equipment without prior agreement by PCM and Yard Committee.

All children underthe age of 12 must be accompanied by an adult (a responsible person over 18years of age).  When in the vicinity ofthe Haven, the Slipways or on the Pontoons, children must wear lifejackets.

No vessels orvehicles may be used on the Club premises for commercial gain, charter or anyillegal purposes.

All persons usingthe premises shall conduct themselves with due regard to the safety, comfortand convenience of others, including those in neighbouring properties.  The Club does not accept responsibility forany disturbance or inconvenience due to building or other works being carriedout on the premises or adjoining land.

No loose items ofboat gear, supplies or the like, shall be left unattended upon the pontoons,car parks or Yard.

Rubbish, paintingmaterials, used engine oil, batteries etc. shall only be disposed of in the designatedreceptacles.

Dogs must be kepton a lead at all times and must not be allowed to foul the premises.  The owner of the dog shall be responsiblefor the removal of any such fouling.

The use of theClub premises for carrying out any work on vessels is reserved for Memberscarrying out maintenance only, and for the Club’s franchisees.  Requests for other contractors to work onthe premises must be made to the Secretary prior to their commencement on site.  The conditions under which the contractorsare permitted to work are available from the Secretary.  Boat keys held in the main reception willnot be given to Contractors unless the Member has given the Office Staffprior permission.  A Member wishing tohave a friend to assist him in the work on his boat may do so if the Memberis present and the friend is booked into the Club as a guest.

STORAGE ASHORE

All applicationsfor storage of vessels on the premises must be made to the Secretary on theappropriate form.

The Club shallhave the right to board, enter or carry out emergency work on any vessel, atthe Member’s expense, if in the Club’s opinion such action is necessary forthe safety of the vessel or for the safety or convenience of other users ofthe premises.

Any vessel orvehicle on the premises may be moved by the Club without prior notice to theowner.

WORKING ON VESSELS

Vessels stored atseasonal rates ashore will be hauled-out, launched or put afloat as near theend of the seasonal period as, in the Club’s opinion, tide, weatherconditions and available facilities allow and in such sequence as to avoidmoving other vessels for this purpose. If a Member requests the Club to haul-out, launch or move a vessel outof sequence, which requires other vessels to be moved, or special facilities,this will only be carried out at the expense of the Member and at the Club’sdiscretion.

Any boat movementsinto or out of storage at the premises must be notified to the Cluboffice.  All requests for haul-up,launch off, etc. are to be made to the Club office, in writing using the PCMYard Work Request Form.

All vessels andtrailers must bear the boat’s name in such a position that it can readily beseen, even when the vessel is fitted with a cover.  Trailers must bear the current season PCMsticker.  Any unmarked vessel ortrailer may be impounded.

Spare keys forwheel-clamps and hitch locks must be left with PCM office, as boats ashoremay have to be moved for access without the owner present.

All sailing boatswith fin keels shall provide, or hire from the Club, legs or cradles suitablein construction for the vessel size and maintained in good order.  The Club will refuse to store vessels that,in the Club’s judgement, do not meet these requirements.  Cradles and legs must not be left in theYard during the summer period and must be removed by the Member.  All Trailer boats must be removed from theYard at the end of the season.  Doublestorage may be charged if cradles, legs or trailer boats remain on thepremises more than 7 days after due date.

All vessels(including dinghies and tenders) must be stored in the place allocated forthem from time to time by the Club. 

SALE OFBOATS

A Member shallnotify the Club of the intended sale of his vessel stored or kept at theClub, or on a Club mooring, and shall sign all potential buyers of the vesselinto the Club as guests and be responsible for them.

When a Membersells his vessel to a person who is not a Member of the Club, the purchasershall remove the vessel from the Club’s premises within fourteen days or theclub reserves the right to remove it to a commercial marina or yard at thetotal risk and expense of the Member.

Where brokers areinstructed by the Member, the Member must ensure that they inform the Clubprior to any visit by potential buyers. A 1% commission on the gross sale price will be levied on all craftsold through a broker if the craft is on a Club mooring or on the Club’spremises.  The Member shall notify theClub within seven days of the sale, transfer or mortgage of any vessel storedor kept at the Club, or on a Club swinging mooring, which is the subject of acurrent agreement granted to the Member by the Club subject to theseconditions.

CHARGES

Charges for allboatyard and boatshed facilities and services, together with mooring charges,are decided by the marina and Yard Committee and approved by the GeneralCommittee who reserve the right to amend or alter them as necessary.  Current charges lists are available fromthe Secretary.

The Club has theright to exercise a general lien upon any vessel or property of the Memberwhilst on the Club’s premises until such time as any money due to the Club ispaid.

FIRE PRECAUTIONS

The Member shalltake all necessary precautions against the outbreak of fire on his/her vesseland shall observe all statutory and Club regulations relative to fireprevention.  The Member shall provideand maintain at least one BSI (British Standards Institution) or TSI TurkishStandards Institution) Standard type fire extinguisher of suitable size onthe vessel at all times.

No dangerous,inflammable or poisonous chemicals or liquids are permitted on the premisesexcept in properly secured containers.  Re-fuelling in the marina, Yard or Shedis forbidden.

Members mustensure that all liquid gas containers are turned off when leaving theirvessels unattended.  It is recommendedthat all gas cylinders be removed from vessels prior to being stored in theboatshed or boatyard.

At no time mayelectric fan heaters or any other heater with an exposed element or flame beused on boats on the premises.

LAUNCHING & HAUL-OUT

(NOTE: The maximum dimensions and weight forthe use of the hoist
are length overall 24m, draft 3m, weight 100tons).

When a vessel isbeing moved to or from the water by the boat-rig, or ‘bomb trolley’, no morethan the minimum required crew may remain aboard.  When boats are being launched or recoveredfrom/to their own road trailers, the driver only may be in the boat.  All crew and passengers must be embarkedand disembarked from the Victualling Pontoon. Children must not be allowedaboard during launching and haul-out by any method.

All sea-cocks etc.must be closed and checked by the Member prior to launching.  If this is not possible for any reason itis the Member’s responsibility to inform the Secretary of the number andposition of all sea-cocks aboard.

Lifting Keelsand/or Rudders must be placed in the raised position by the Member before
lift-out.

All Members usingthe slipway to launch and recover their own craft on trailers must have theirnames entered in the Register which is kept in the office.  All boats on the Register must haveidentifying stickers for the trailer. An annual fee will be charged – see list of charges.

SERVICES

Water hoses aresupplied at various points around the premises and Members must re-coil themafter use and turn off taps to preserve water.

Electricity supplyto the premises and therefore to vessels is not guaranteed.  The loading to any vessel must not exceed 5amps and therefore may not be adequate to run sufficient equipment to keep avessel completely frost and damp free during the winter months.  Members must take other precautions toprevent frost and damp damage.

The Club willendeavour to have a representative in attendance on the premises during thefollowing hours:

The Club launch isin service from 1st April to 31st October.  The schedule of times is shown in theSummer Season Programme and on the Notice Board.  The launch service will be suspended shouldsea and weather conditions preclude safe operation. 
Note: maximum number of passengers is 12.

Members must parktheir vehicles in such a manner and position as the Club shall from time totime direct.  No vehicle may be parkedin the boatyard or boat-shed at any time without specific permission of theSecretary, marina/Yard Committee Chairman or a Flag Officer.

CAR & VEHICLE PARKING

Members wishing topark vehicles on the premises between 48 hours and 60 hours must deposit thekeys with the Main Office or Yard Staff if office is closed.  Vehicles parked continuously over a periodof 60 hours require the written permission to the Club Secretary, inadvance.  Each Member, together withhis/her crew and visitors, may not occupy more than two parking spaces.

Official PCM andvisitors’ stickers must be displayed on vehicles at all times.
